Terms of purchase and return

  • 1. General Provisions
    1.1. These Terms and Conditions of Purchase and Sale of Goods (hereinafter – the “Terms”) constitute a binding legal document for the Parties, establishing the rights, obligations, and liability of the Buyer and the Seller when the Buyer purchases goods from the online store.
    1.2. The Seller reserves the right to amend, modify, or supplement these Terms at any time in accordance with applicable legal requirements. The Buyer shall be informed of such changes on the online store website. The Terms in force at the time of placing the order shall apply to each purchase.
    1.3. The right to purchase goods in the online store is granted to:
    1.3.1. legally capable natural persons who have reached the age of majority and whose legal capacity is not restricted by a court;
    1.3.2. minors between 14 and 18 years of age only with the consent of parents or guardians, except in cases where they independently manage their own income;
    1.3.3. legal entities;
    1.3.4. authorized representatives of all the above-mentioned persons.
    1.4. By approving these Terms, the Seller also confirms that, in accordance with Clause 1.3, the Buyer has the right to purchase goods in the online store.
    1.5. The contract between the Buyer and the Seller shall be deemed concluded from the moment the Buyer forms a shopping cart in the online store, specifies the delivery address, selects the payment method, reviews these Terms, and clicks the “Confirm Order” button (see Section 5 “Ordering of Goods, Prices, Payment Procedure, Deadlines”).
    1.6. Each contract concluded between the Buyer and the Seller shall be stored in the online store.

    2. Personal Data Protection
    2.1. The Buyer may order goods in the online store:
    2.1.1. by registering in the online store and providing the required registration data;
    2.1.2. without registering in the online store.
    2.2. When ordering goods using the methods specified in Clause 2.1, the Buyer must provide personal data necessary for the proper execution of the order in the information fields provided by the Seller, including: name, surname, delivery address, telephone number, and email address.
    2.3. By approving these Terms, the Buyer agrees that the personal data specified in Clause 2.2 may be processed for the purposes of selling goods and services in the Seller’s online store, analyzing the Seller’s activities, and for direct marketing purposes.
    2.4. By agreeing to the processing of personal data for the purpose of selling goods and services in the Seller’s online store, the Buyer also agrees to receive informational messages necessary for order fulfillment to the provided email address and telephone number.
    2.5. By registering in the online store and ordering goods, the Buyer undertakes to keep their login credentials secure and not to disclose them to third parties.

    3. Buyer’s Rights and Obligations
    3.1. The Buyer has the right to purchase goods in the online store in accordance with these Terms and the procedures specified in other informational sections of the online store.

    3.2. The Buyer has the right to withdraw from the purchase and sale contract with the online store by notifying the Seller in writing (by email, specifying the product to be returned and the order number) no later than within 14 (fourteen) business days from the date of delivery of the goods, except in cases where withdrawal from the contract is not permitted under the laws of the Republic of Lithuania (see information on the website of the State Consumer Rights Protection Authority:

    3.3. The right specified in Clause 3.2 may be exercised only if the goods have not been damaged, have not significantly changed in appearance, and have not been used.
    3.4. The Buyer undertakes to accept the ordered goods and pay the agreed price for them.
    3.5. If the Buyer’s registration data changes, the Buyer must immediately update such information.
    3.6. The Buyer undertakes not to transfer their login credentials to third parties. If the Buyer loses their login credentials, they must immediately inform the Seller using the contact details provided in the “Contacts” section.
    3.7. By using the online store, the Buyer agrees to these Terms and undertakes to comply with them and with the laws of the Republic of Lithuania.

    4. Seller’s Rights and Obligations
    4.1. The Seller undertakes to provide all conditions necessary for the Buyer to properly use the services of the online store.
    4.2. If the Buyer attempts to damage the stability or security of the online store or violates their obligations, the Seller has the right to immediately, without prior notice, restrict or suspend the Buyer’s access to the online store, or, in exceptional cases, terminate the Buyer’s registration.
    4.3. The Seller undertakes to respect the Buyer’s right to privacy regarding the Buyer’s personal information provided in the registration form of the online store.
    4.4. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer. If the required goods are not available in stock, the Seller undertakes to offer the Buyer an аналогous product at a similar price.

    5. Ordering of Goods, Prices, Payment Procedure, Deadlines
    5.1. The Buyer may purchase goods in the online store 24 hours a day, 7 days a week.
    5.2. The contract enters into force from the moment the Buyer clicks the “Confirm Order” button, and the Seller confirms the order by sending a confirmation email to the Buyer’s specified email address.
    5.3. The prices of goods in the online store and in the formed order are indicated in euros, including VAT.
    5.4. The Buyer may pay for goods using one of the following methods:
    5.4.1. Bank transfer – advance payment, where the Buyer pays the received invoice from their bank account. If the invoice is paid from a bank account other than the Buyer’s personal account, the payment order must specify the Buyer’s name, surname, and invoice number.
    5.4.2. Cash payment to the courier upon delivery of goods.
    5.4.3. Payment upon collection of goods at the Seller’s specified address. Goods may be collected at the MasterCity store, Kirtimų g. 2, Vilnius. Payment can be made in cash or by bank card.
    5.5. The Buyer undertakes to pay for the goods as soon as possible. The preparation of the shipment and calculation of the delivery period begin only after payment has been received.

    6. Delivery of Goods
    6.1. When selecting delivery during order placement, the Buyer undertakes to provide an accurate delivery address.
    6.2. The Buyer undertakes to accept the goods personally. If the Buyer cannot accept the goods personally and the goods are delivered to the specified address, the Buyer shall have no right to make claims against the Seller regarding delivery to an improper recipient.
    6.3. Goods are delivered by the Seller or by a representative authorized by the Seller (courier).
    6.4. The Seller delivers goods in accordance with the delivery periods specified in the product descriptions. These periods are preliminary and do not apply when the required goods are not available in the Seller’s warehouse. In such cases, the Buyer shall be informed of the shortage. The Buyer also agrees that, in exceptional cases, delivery may be delayed due to unforeseen circumstances beyond the Seller’s control. In such cases, the Seller undertakes to immediately contact the Buyer and agree on delivery conditions.
    6.5. The Seller shall be released from liability for violation of delivery deadlines if goods are not delivered or are delivered late due to the Buyer’s fault or circumstances beyond the Seller’s control.
    6.6. The Buyer must immediately inform the Seller if the shipment is delivered in damaged packaging, contains unordered goods, incorrect quantities, or incomplete product sets.
    6.7. If packaging damage is noticed upon delivery, the Buyer must record remarks in the delivery document provided by the courier or draw up a separate damage report in the presence of the courier. Failure to do so releases the Seller from liability for damage related to packaging defects not noted in the delivery documents.

    7. Product Quality and Warranty
    7.1. The data for each product sold in the online store is generally provided in the product description.
    7.2. The Seller is not responsible for discrepancies in color, shape, or other parameters caused by the Buyer’s display settings.
    7.3. For certain products, the Seller provides a quality warranty for a specific period, which is indicated in the product description.
    7.4. If no warranty is provided, the warranty established by applicable legislation shall apply.

    8. Return and Exchange of Goods
    8.1. Defects in sold goods are remedied, and low-quality goods are replaced or returned in accordance with the Rules for the Return and Exchange of Goods approved by Order No. 217 of the Minister of Economy of the Republic of Lithuania dated June 29, 2001, except where withdrawal from the contract is not permitted by law. Refunds are made only to the payer’s bank account.
    8.2. To return goods, the Buyer must notify the Seller within 14 (fourteen) business days from the date of delivery, indicating the product name, order number, and reason for return.
    8.3. Returned goods must:

    be in original, undamaged packaging;

    be undamaged;

    be unused and retain commercial appearance (labels intact, protective films not removed), except in cases of defective goods;

    be complete;

    be returned with proof of purchase.

    8.4. The Seller has the right to refuse acceptance of returned goods if the Buyer fails to comply with the return conditions.
    8.5. If incorrect or defective goods are delivered, the Seller undertakes to collect and replace them with appropriate goods.
    8.6. If replacement is not possible, the Buyer shall be refunded the amount paid, excluding delivery costs.

    9. Liability of the Buyer and the Seller
    9.1. The Buyer is fully responsible for the accuracy of personal data provided.
    9.2. The Buyer is responsible for actions performed using the online store.
    9.3. If a third party uses the online store with the Buyer’s credentials, such person is considered the Buyer.
    9.4. The Seller shall not be liable for losses incurred due to the Buyer’s failure to familiarize themselves with these Terms.
    9.5. The Seller is not responsible for content or activities of third-party websites linked in the online store.
    9.6. In case of damage, the responsible Party compensates the other Party for direct losses.

    10. Marketing and Information
    10.1. The Seller may initiate promotions in the online store at its discretion.
    10.2. The Seller may unilaterally change or cancel promotions without prior notice. Changes apply only from the moment they are made.
    10.3. All notifications are sent using the contact details provided during registration.
    10.4. The Buyer sends inquiries using the contact details provided in the “Contacts” section.
    10.5. The Seller is not responsible if the Buyer does not receive messages due to internet or email service disruptions.

    11. Final Provisions
    11.1. These Terms are drafted in accordance with the laws and regulations of the Republic of Lithuania.
    11.2. All disputes arising from these Terms shall be resolved through negotiations. If no agreement is reached, disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
